TOWN BOARD MINUTES
 MARCH 18, 2004

A regularly scheduled meeting of the Town of Esopus Town Board was held on Thursday, March 19th at 7:30 PM at the Town Hall on Broadway in Port Ewen, New York with the following persons in attendance:

Supervisor Ray Rice called the meeting to order at 7:30 PM

Pledge to the Flag

Announcements: There is a vacancy on the Assessment Board of Review with the resignation of Les Braunstein who is moving out of town.  Applicants are needed.  The Grievance Board meets the end of May for Grievance Day when people can challenge their assessment.

Public Comments:

Glen Dewitt - Riverview: Glen Dewitt has a condo at Riverview.  He is concerned with the stretch of road parallel to the George Freer Memorial Park also known as the “J” Road.  This road is used by walkers, bike riders, people walking their dogs, but it has become a “drag strip” and this is an on going problem.  The sheriff has been called but by the time they arrive those creating the disturbance have left the scene.  It is impossible to see the license numbers on the cars since the condos are so high and you are looking down when you see them.  This is a “unique” road and he believes it is an accident awaiting to happen.  Mr. Dewitt’s suggestion is to place speed bumps in the road to alleviate the problem.

The “J” Road is maintained by the Esopus Highway Dept. according to Supervisor Ray Rice and there are legal problems placing speed bumps.  Supervisor Rice suggested to keep calling the sheriff and ask for a “blotter entry”.  This is an enforcement issue as far as Supervisor Rice is concerned.  Glen Dewitt believes it is more than an enforcement issue it is a legal issue and the problem will get worse and someone will be hurt.

Councilman Wayne Freer would like to look into the matter.  It is an unusual public road and we need to know what the ramifications are with speed bumps.

Ray Kowatch - Port Ewen: Mr. Kowatch was interested in the real estate available for a new Town Hall.  Supervisor stated a dozen parcels have been received, one or two had a swamp view.
 
There will be a meeting with the New York State Dept. of Transportation on Wednesday, March
31st at 7:30 PM in the Town Hall in Port Ewen, New York.

1.  Resolution to Authorize Attendance of the Building Inspectors at the New York State
     Building Codes Conference

Be it Resolved, by the Town Board of the Town of Esopus, in the county of Ulster, as follows:

Whereas, New York State will conduct a Building Codes Conference April 21-23, 2004 in Poughkeepsie, New York,

Therefore, Be it Resolved, that the Town Council authorizes the attendance of Building Inspector Mark Reiker and Fire Inspector Mike Glotzl, the expenses to be paid from the Building Dept. budget,

2.  Resolution to Authorize Formation of a Committee to Review the Town of Esopus             Zoning Ordinances

Be it Resolved, by the Town Board of the Town of Esopus, in the County of Ulster, as follows:

Whereas, a number of errors and omissions exist in the Town of Esopus Zoning Code,

Therefore, Be it Resolved, that to correct this situation, the Town Board authorizes the creation of a committee to review the existing code and present the committee’s recommendations to the Town Board.  The Review Committee will consist of a member from the Planning Board, a member of the Zoning Board of Appeals, one member from the Building Department, and one member from the Town Board.  The various Boards are responsible for selecting the members to represent their Board on the Review Committee.  It is suggested that the Planning Board representative act as chairperson of the Review Committee.  The Town Board requests that a report be presented to the Board within 90 days of the formation of the Committee.

3.  Resolution to Authorize Adjustments of the 2004 Budget

Be it Resolved, by the Town Board of the Town of Esopus, in the County of Ulster, as follows:

Whereas, adjustments to the 2004 budget are required in order to properly reflect changes in certain accounts,

Therefore, Be it Resolved, that the Town Board authorizes the transfer of the following amounts from the indicated accounts and Fund Balances to the indicated active accounts.

4.  Resolution Authorizing the Payment of Bills Received Since the February Board Meeting

Be it Resolved, by the Town Board of the Town of Esopus, County of Ulster as follows:

Whereas, the Town of Esopus has been presented with vouchers for payment and these vouchers have been examined and approved by the Town Board,

5.  Motion to Accept the Minutes of the February Town Board Meetings

A MOTION WAS MADE BY SUPERVISOR RAY RICE AND SECONDED BY COUNCILMAN WAYNE FREER TO ACCEPT THE MINUTES OF THE FEBRUARY TOWN BOARD MEETINGS.  ALL TOWN BOARD MEMBERS VOTED IN FAVOR.  MOTION CARRIED.

6.  First Reading for the Prior Notice Local Law and Repealer

Supervisor Rice explained our present local law is insufficient according to our insurance company.
In order to pass a new local law we must first repeal our present local law and that is what Local Law #1 does.  Local Law #2 tightens up our prior notice law.  These laws are available for review at the Town Clerk’s Office.  We will hold a Public Hearing on Local Law #1 at our next Town Board Meeting on April 15th at 7:15 PM and at 7:20 PM we will hold a Public Hearing on Local Law #2.

Public Comment:

Robert Richter - Esopus: Robert Richter asked if the Town Board had come to any conclusion on the tax case he has against the Town?  He is under pressure to get back to the New York State Appellate Court for their decision on the case.  Supervisor Rice stated the Town Board had expressed their desire regarding the case to their attorney and he is in the process of contact Bob Richter’s attorney.

Ira Weiner - West Park: Ira Weiner asked in what areas did the Town Board had a problem with the zoning?  Supervisor Rice gave several examples:

A.  Incorrect fees listed for abstracts
B.  Junk tires are not specified
C.  Building Permit Renewals have no time limit (some people have
                 renewed their permits for twelve years) and the project is never completed.
D.  No provisions for a Stop Work Order for logging.

Ira Weiner continued and asking about the secretary for the Recreation Board?  The Recreation Board has chosen Sarah Lee Hewitt as their secretary.

Anne Gordon - Port Ewen: Anne Gordon spoke about long time resident Barbara Maynard who has moved and will be living with one of her children.  She served as Librarian for many years and provided the townsfolk with her “salty” humor.  She will be missed.

Ray Kowatch - Port Ewen: Ray Kowatch asked if there was any news concerning the Spinnenweber property?  There was nothing new.
