TOWN BOARD MEETING

April 19, 2007

 A regularly scheduled meeting of the Town of Esopus Town Board was held on Thursday, April 19, 2007 at 7:30 PM in the Town Hall on Broadway Port Ewen, New York with the following persons in attendance:

Opening:  Supervisor John Coutant called the meeting to order at 7:30 PM.

Public Comment: None

 1.  Town Hall Update

 The bids for the new Town Hall will be advertised and the bids should be awarded May 24th at 2 PM.

2.  Storm Problem Update

 After almost seven inches of rain with the Nor’easter last Sunday and Monday our area has had damage.  State roads, county roads, and local roads have flooded.  The Rondout Creek has three major marinas and there has been damage to their docks.  There has been damage to our business area.  We had a major amount of water coming off the property above our Port Ewen Water Plant on River Road.  A 30 foot piece of the bank was taken out and ended up on the River Road and it has affected our water plant.  Several engineers have come to assess the damage so we can fix the problem.   An Emergency Meeting will take place on Monday April 23, 2007.  The weather forecast is not in our favor over the next few days.  Supt. Don Kiernan has suggested we have a press release to ask our residents to conserve water until the situation is fixed.  At this time we have a minor leak in the main pipe line from the main plant up River Road.  Supt. Kiernan addressed the Town Board:

            Ulster County Health Dept., Brinnier & Larios Engineers, City of Kingston Water Supt. Judy Hanson have been contacted.  We have had significant damage to our water plant, the blacktop, fire hydrants have beaked.  We now have a leak under our building.  Ulster County Health Dept. states we must have an emergency plan.  If we lose the ability to make water at the plant we will tie into Kingston.  We have lined up a contractor to repair the problem.  A press release needs to be done asking our residents to volunteer to conserve water.   River Road has shifted an inch overnight and this will continue for a few days.  This shifting has carried yards of earth with it. 

            Supervisor Coutant said Ken Silver, the owner of the property across from the water treatment plant, has called his engineers to the property on the upper end of the area.  There is a giant field on the top end of this plateau and it has shifted.  Can we divert the water into some other type of system?  He will have all the principals there on Monday at this Emergency Meeting.

FEMA is being asked to come in.  Last Friday people in Albany told us about the seriousness of the storm coming and asked me to call the people who may be affected.

            Art Snyder from the Ulster County Emergency Management has been there to help.  It is a matter of taking this information, putting it together and determining where the priorities are.  We are hoping we don’t get any more rain stated the Supervisor.

            Supt. Kiernan said the property next to the water plant has extensive damage to its foundation and the road in front of his property.  Councilperson Wayne Freer asked if the road was opened?  It was open.  The road may need to be closed until this problem is resolved.  The weight capacity of the road needs to be addressed and an emergency weight limit set in place.  If the road is shifting Ulster County needs to know about it immediately.  Rob Wells from Ulster County Highways and Bridges was in attendance at this meeting.  He was aware of the problem, however, he was unaware of this latest leak  and notified the county at this point and it was suggested the road be open only to local residents..  Port Ewen Fire Dept. was contacted.   Patty Kowatch called the school district to notify the bus carriers.

            Councilperson Freer asked do you think a press release asking residents to conserve is appropriate at this time?  Supt. Kiernan stated we are having a significant problem and the public should know what may transpire.  Councilperson Lange stated nothing more can be done at this time.  Supt. Kiernan said we have made the move to have the pipe fixed and we may need some time.  We have made arrangements with the City of Kingston.  We are applying for a permit to put a pipe on the Rondout Bridge and we have applied for the insurance.  The weight limit will be over the bridge weight limit and the bridge may have to be closed.  We can place an emergency pump behind the old bridge to Rondout Harbor, however, it will be noisy.  We need the pump to boost the pressure.  The City of Kingston has an old pump that may not work....we are looking for a new pump at this point.  A storage tank is now up to twenty eight feet and forty feet is as high as you can go.  We are excavating now at the plan.  We may have to hire a geo-technical engineer.

            Supervisor Coutant was advised by Architect Joseph Hurwitz that the property on the other side of River Road also has significant damage.  Councilperson Silvestro said this is not just a generalized problem.  We will take care of the immediate emergency first..

3.  Easter Egg Hunt

 The Easter Egg Hunt was very successful according to Supervisor Coutant.  Thanks go to the Recreation Board and primarily to Kathy Robinson.  It took only one minute to pick up 1,700 eggs.  Three major baskets were given out.  There were refreshments for the adults and the families had a good time.  Pictures were taken with the Easter Rabbit.  The next plan is to do the same type of thing for the Memorial Day Parade. 

4.  Resolution for Highway Superintendent Request

 Whereas, Alan Larkin, Highway Supt. has requested that he and his Deputy Supt. be allowed to attend Highway School in Ithaca, New York on June 4th thru June 6th,

Whereas, he has advised that the cost of registration is $85.00 per person and the cost of lodging is $129.99 per night,

Therefore, Be it Resolved, that the Supt. Larkin and Deputy Supt. Rodschat be authorized to attend this school and the expenses be paid for by the Town of Esopus.

5.  Resolution for Municipal Clerks’ Week

 Whereas, the Office of the Municipal Clerk, a time honored and vital part of local government exists throughout the world, and 

Whereas, the Office of the Municipal Clerk is the oldest among public servants, and

Whereas, the Office of the Municipal Clerk provides the professional link between the citizens, the local governing bodies and agencies of government at other levels, and

Whereas, Municipal Clerks have pledged to be ever mindful of the neutrality and impartiality, rendering equal service to all.

Whereas, the Municipal Clerk serves as the information center on functions of local government and community.

Whereas, Municipal Clerks continually strive to improve the administration of the affairs of the Office of Municipal Clerk through participation in education programs, seminars, workshops and the annual meetings of their state, province, county and international professional organizations.

Whereas, it is most appropriate that we recognize the accomplishments of the Office of the Municipal Clerk.

 6.  Memorial Day Parade

 The American Legion, the Recreation Board, the Highway Supt and the Ulster County Sheriff will be involved in the Memorial Day Parade.  This will be an excellent parade in our town to be held on May 28th.

 7.  Zoning Board of Appeals Resignation - Richard Wenzel

 The Town Board has received the resignation of Richard Wenzel from the Zoning Board of Appeals due to personal work commit1ments.  This letter was received April 10th.  We are looking for another person to serve on the ZBA. 

8.  Resolution to Authorize Adjustments to the 2007 Budget

 A Motion to approve the previous months minutes was made by Councilperson Michael Lange and seconded by Councilperson Wayne Freer.  All Town Board Members voted in favor.  Motion Carried.

 12.  Press Release

 A press release will be sent advising resident to conserve water.  The release will be written by Supervisor Coutant and Supt. Don Kiernan and this meeting will be for both the Town Board and the Port Ewen Water and Sewer Board.

13.  Summer Park Program

 A notice for sign ups for our Summer Park Program will need to be scheduled with Director Julie Habernig.  Registration will be the end of May. 

14.  Tim Keefe - Building Inspector

 Where is Tim Keefe in relation to the hiring of a new building inspector asked Councilperson Wayne Freer?  Supervisor Coutant stated there were two lists of applicants from the county and he has had only two people come for interviews.  He will be asked to attend our next Workshop Meeting.  The closing date for the next test will be in ten weeks.

15.  Motion to Purchase Loud Speaker

 A Motion to purchase a Loud Speaker System for our town activities was made by Councilperson Wayne Freer and seconded by Supervisor Coutant with the money coming from the General Fund.  All Town Board Members voted in favor.  Motion Carried.

 16.  Appointment ZBA Member

 With the resignation of Richard Wenzel there will not be a quorum at next months ZBA Meeting, therefore, it is in the town’s  best interest to act as quickly as possible in replacing this member.  The ZBA Secretary Kathy Kiernan has applied for this position in the past and she is willing to serve.   Councilperson Freer said the Town Board’s concern is Kathy Kiernan is such a excellent secretary that finding another secretary will be hard.  Councilperson Silvestro thought the ZBA Meeting next month should be postponed. 

Councilperson Michael Lange made a Motion to appoint Kathy Kiernan to fill the vacancy of Richard Wenzel on the Zoning Board of Appeals and Councilperson Gloria VanVliet seconded the Motion stating Kathy Kiernan will be very good.

 Nancy Henry will become the Zoning Board Secretary.

17.  Announcements

 Councilperson Deborah Silvestro said on April 29th the Environment Board will give free trees to the residents in the Town of Esopus.  There will be a contest asking local children in to produce a piece of art, an essay or picture about trees and how they benefit us.  There will be a DEC forester from 12 PM - 2 PM at the Town Hall.

Klyne Esopus has their Recognition Dinner on Thursday April 29th.

The Library grand opening has been postponed until April 21st due to last weeks storm.

Robert Graves School has their 50th Anniversary celebration on April 21st.

Saturday is the Great River Sweep at Sleightsburgh Park.

Public Comment:

 Pat Bennett is Patty Kowatch’s Mom and she does not think school buses should be allowed on River Road.

18.  Executive Session

 Councilperson Freer asked where we stood with Bookkeeper Bernadene Quimby?  A Motion to enter into Executive Session was made by Councilperson Wayne Freer and seconded by Councilperson Gloria VanVliet to discuss a personnel matter in the Bookkeeper’s Office.

 This Motion took place a 8:50 PM.  All Town Board Members voted in favor.

 A Motion to adjourn from Executive Session was made by Councilperson Wayne Freer and seconded by Councilperson Deborah Silvestro at 9:10 PM.  All Town Board Members voted in favor.  Motion Carried.

 A Motion to reconvene our regular meeting was made by Councilperson Wayne Freer and seconded by Supervisor John Coutant at 9:11 PM.  All Town Board Members voted in favor.

 A Motion that the issue discussed in Executive Session go before our attorney for a decision was made by Councilperson Wayne Freer and seconded by Supervisor John Coutant.  All Town Board Members voted in favor.  Motion Carried.

 A Motion to adjourn was made by Councilperson Wayne Freer and seconded by Councilperson Michael Lange at 9:12 PM.  All Town Board Members voted in favor.  Motion Carried.
