TOWN BOARD MEETING

JUNE 17, 2010

 

A regularly scheduled meeting of the Town of Esopus Town Board was held on Thursday, June 17, 2010 at 7:40 PM at the Town Hall on 284 Broadway in Port Ewen, New York with the following persons in attendance:

PUBLIC COMMENT:  NONE

 

Supervisor John Coutant called the meeting to order at 7:40 PM.

 

1.  WATER CHESTNUT HARVESTER MACHINE UPDATE

 

The Water Chestnut Harvester was delivered to the Highway Garage.  The machine was slightly damaged during the transportation.  Repairs will be made by Alpha Boats on Monday, June 21st.  Following the repair the vessel will be launched before the week is out.

 

2.  WATER CHESTNUT HARVESTER REPAIRS AND TRAINING SCHEDULE

 

The Water Chestnut Harvester is larger than what we expected and it is better equipment than the unit we had before.  It will have the capacity to carry 10,000-12,000 lbs. of water chestnuts.  There are two girts coming from the back of the vessel and it will anchor the vessel in one spot.  We look forward to using the machine.  At this time we have no anchor or lines to hold the vessel.  Alpha boats will bring the anchor and the lines with them on Monday.  At this time the training will also be done.

 

3.  BEACH PROPERTY UPDATES – TITLE SEARCH (PAUL KELLAR, ESQ.)

 

Our Attorney is doing a complete title search of the river property next to George Freer Memorial Beach which the town is trying to purchase for back taxes.  We have only sixty days to get things done and there is no apparent problem.  The Supervisor is comfortable and positive we will take this property and challenge the boards to start doing something constructive that will be pleasing to everyone.

 

Sarah – Resident from Riverview:  Will you own the property within sixty days?  The Supervisor explained we have sixty days to do a title search.  If a lien was found it would not be feasible to buy the property.  We have to make certain what we are doing will be legal.

 

 

 

 

 

 

 

4.  FEMA/SEMO – PROJECT BIDS – PROJECT BIDS & RESOLUTION

 

Due to the floods in 2007 there was damage done to our water treatment plant.  FEMA and SEMO have pledged to pay for the repair, however, the town must foot the expense first and send the bills on.  We have taken out a Bond Anticipation Note to provide the funding. 

 

RESOLUTION OF THE TOWN BOARD

JUNE 17, 2010

 

Whereas, the flooding event of April 16-17, 2007 caused a major slope failure on property along a portion of River Road in the Town of Esopus, and

 

Whereas, there has been land movement and associated damage to River Road and the Roger Mabie Water Filtration Plant, said plant being a critical component of the Port Ewen Water District, and

 

Whereas, certain improvements have been designed in consultation with the State Emergency Management Office (SEMO) and the Federal Emergency Management Administration (FEMA) in order to stabilize the property and replace equipment damaged by the flooding event, and

 

Whereas, these improvements are contained to two separate bidding proposals:  Contract TE-101-Drainage Improvements at the Roger Mabie/Port Ewen Water Plant and Contract TE-082 Clarifier Replacement at the Roger Mabie/Port Ewen Water Plant, and

 

Whereas, these improvements are vital to the health and safety of the residents and customers of the Port Ewen Water District.

 

Therefore, Be it Resolved, by the Town Board, Pursuant to General Municipal Law Section, that these two projects be advertised for public bidding on June 18, 2010 and that bids are to be received on July 13, 2010.

The Supervisor explained the clarifier can only be replaced at certain times of the year due to temperature variations.  The manufacturer would have to begin the construction soon. 

 

5.  ROSE PROPERTY DEMOLITION COMPLETED

 

The town had a problem with a house on the Rose Property and we decided to demolish the house.  The Building Inspector has reported he reviewed the property and the demolition is complete.  The bill for

the demolition has been sent to the town.  The Assessor has been advised to place the amount of the bill on the taxes for collection.

 

 

 

 

 

6.  OPENING OF BOWNE STREET/FIRE COMMISSION’S LETTER

 

The Supervisor read the following letter from the Port Ewen Board of Fire Commissioners:

 

June 3, 2010

 

Dear Mr. Coutant:

 

At the June meeting of the Board of Fire Commissioners, the Board discussed the current lack of a secondary access road to the Town Hall.  At the recent memorial Day Parade several pieces of emergency apparatus were parked near the Town Hall and should there have been a fire call would have had difficulty exiting the premises or may not have been able to exit.  The Board of Fire commissioners is asking that the emergency access road from the Town Hall to exit on Bowne St. be opened and made usable for Fire Apparatus at this time to prevent this from occurring again and to aid in emergency response.

 

Additionally, the Board of Fire Commissioners requests that no parking be enforced in the vicinity of the sprinkler connection located to the left of the front door.  This connection needs to be accessible to the Fire Department in the event there were to be a fire.

 

Please advise the Board of Fire Commissioners as to when the road may be opened and no parking at the sprinkler connection is enforced.

Within the next three to five weeks, Highway Supt. Al Larkin. ,  will have an idea of the cost of the proposed road so the Town Board can review the information. 

 

7.  DEC – TOWN OF ESOPUS TRANSFER STATION – ANNOUNCEMENT OF AGREEMENT BETWEEN PC ASSET DISPOSAL AND TOWN OF ESOPUS

 

The Town received a citation for not having our cardboard covered at our Transfer Station.  Curt Dankelmann explained we have never been given the proper container from Ulster County Resource Recovery.  We will call them for the right container. 

 

A second violation concerned garbage said to be in Second Nature containers which will no longer be stored on town property.  DEC found some computer parts outside our container.  In order to avoid residents from throwing out computer equipment we have a proposed contract with PC and Asset

Disposal.  They will provide containers specifically for computers parts by weight.  When the computer parts reach a certain weight the container will be hauled at their expense.  If it is done by weight and the scale is accurate this is good.  The Town Board was asked to review the contract.

 

 

 

 

8.  VIOLENCE IN WORKPLACE

 

The Town has been given orders by the New York State Labor Dept. to create a policy and procedure on Workplace Violence.  We have scheduled training for our employees on June 30th at 9:15 AM.  Councilperson Donna McAuley and Councilperson Wayne Freer have worked on the policy before us. 

 

The purpose of the policy is as follows:

 

“The employer known as the Town of Esopus has a commitment to promoting the safety and well-bring of all people in our workplace and providing an environment that is free from physical violence, threats and intimidation.  The purpose of this policy is to prevent workplace violence from occurring to the fullest extent possible, and set forth procedures to follow when such violence has occurred.”

 

Training of our town policy will take place on Wednesday, June 30th at 9:15.  This is a mandatory meeting.  Copies will be available for anyone who is interested.  The Supervisor stated there has never been a problem since he has been in office. 

 

9.  RESOLUTION TO PASS VIOLENCE IN WORKPLACE POLICY AND PROCEDURE

 

RESOLUTION TO ADOPT WORKPLACE VIOLENCE PREVENTION POLICY

JUNE 17, 2010

 

WHEREAS, Section 27-b of the New York State Labor Law requires employers to develop and implement programs to prevent and minimize workplace violence caused by assaults and homicides; and

 

WHEREAS, public employers with a combined total of twenty or more full-time employees are required to develop and implement a written workplace violence policy,

 

WHEREAS, written workplace violence has been completed; and

 

NOW, THEREFORE, BE IT RESOLVED, that the Town of Esopus hereby adopts the Workplace Violence Prevention Policy dated June 17, 2010.
