A regularly scheduled meeting of the Town of Esopus Town Board was held on Thursday, September 16, 2004 at 7:30 PM in the Town Hall on Broadway in Port Ewen, New York with the following persons in attendance:

Supervisor Rice called the meeting to order at 7:30 PM.

Announcements:
1. The 9th Annual Fall Festival will be held on Saturday, Sept.
25, 2004. A list of activities for
the day and their locations were announced.
2. There are openings on the Town Recreation Commission.
Any interested volunteers should
contact the Supervisor’s office.

Supervisor Rice called for any public comment. None was made.
RESOLUTIONS:
1. RESOLUTION TO APPROVE THE ISSUANCE OF A PEDDLER’S PERMIT TO
KAREN SCHMITZ
Be it Resolved, by the Town Board of the Town of Esopus, in the County of Ulster, as follows:
Whereas, as per Section 100.5 of the Code of the Town of Esopus, the Town Board is required to accept, and examine, applications for peddling and soliciting, within the Town,
Therefore, be it resolved, that the Town Board has examined the application, accepted, or waived, the required fees, and does hereby authorize the issuance of a Peddler’s license for Karen Schmitz.

2. RESOLUTION TO IDENTIFY A PRIVATE ROAD AS “MIRANDA COURT”
Be it Resolved, by the Town Board of the Town of Esopus, in the County of Ulster, as follows:
Whereas, the private road connecting Rt. 9W and Marc’s Transmission must be identified with a name for recognition by emergency services,
Therefore, be it resolved, that the private road connecting Rt. 9W and Marc’s Transmission be designated “Miranda Court”.
Be it further resolved, that the Town Highway Superintendent have proper signs prepared and installed and that the Assessor’s Office notify Ulster County and 911 of the naming of this private road.
Discussion: Councilman Wayne Freer asked if the Superintendent of Highways was putting up signs on all the private roads. Supervisor Rice and Highway Superintendent Al Larkin noted this was the Town’s responsibility for 911 purposes.

3. RESOLUTION TO APPROVE THE ISSUANCE OF TRAILER COURT LICENSES
Be it Resolved, by the Town Board of the Town of Esopus, in the County of Ulster, as follows:
Whereas, the Town is required to accept, and examine, applications for the renewal of licenses for the operation of Trailer Courts within the Town,
Therefore, be it resolved, that the Town Board has examined the applications, accepted the required fees, and does hereby authorize the issuance of Trailer Court licenses for the following:
Connelly Mobile Home Park
Mirror Lake Mobile Home Park
Dutcher Mobile Home Park
Discussion: Supervisor Ray Rice noted that there are four (4) Mobile Home Parks in the Town of Esopus. However, the 4th, Jing Enterprises, c/o Wang, who was sent four (4) notices of renewal has apparently disregarded all of the same. Supervisor Rice suggested turning this matter over to the the Town’s attorney to pursue. Councilman Gloria VanVliet asked if the license is not renewed, does that mean he can no longer operate a trailer park. Supervisor Rice stated that was his understanding. Councilman Gloria VanVliet agreed with Supervisor Rice in suggesting the same be turned over to the Town’s attorney.

4. RESOLUTION TO APPOINT A REPLACEMENT TO THE ASSESSMENT BOARD
OF REVIEW
Be it Resolved, by the Town Board of the Town of Esopus, in the County of Ulster, as follows:
Whereas, the Town of Esopus Assessment Board of Review has a vacancy resulting from the expiration of Laurie Morse’s term September 30, 2004,
Whereas, the Town Board has solicited and received applications for this position,
Therefore, be it resolved, that after reviewing several very qualified applications, the Town Board appoints Laurie Morse to the Assessment Board of Review for a term expiring September 30, 2009.
Discussion: Supervisor Ray Rice noted that the Town Board just recently appointed Laurie Morse to this Board to replace a member who resigned whose term expired on Sept. 30, approximately 60 days after the Board appointed her. Supervisor Rice stated that this was essentially a reappointment.

5. RESOLUTION TO APPOINT A REPLACEMENT TO THE ENVIRONMENTAL
BOARD
Be it Resolved, by the Town Board of the Town of Esopus, in the County of Ulster, as follows:
Whereas, the Town of Esopus Environmental Board has a vacancy resulting from the resignation of Colin Evans,
Whereas, the Town Board has solicited and received applications for this position,
Therefore, be it resolved, that after reviewing several very qualified applications, the Town Board appoints Stephanie Aivas to the Environmental Board for a term expiring December 31, 2004.

6. RESOLUTION TO AUTHORIZE ADJUSTMENTS OF THE 2004 BUDGET
Be it Resolved, by the Town Board of the Town of Esopus, in the County of Ulster, as follows:
Whereas, adjustments to the2004 budget are required in order to properly reflect changes in certain accounts,
Therefore, be it resolved, that the Town Board authorizes the transfer of the following amounts from the indicated accounts and Fund Balances to the indicated active accounts.

Discussion: Supervisor Ray Rice explained the reason for the adjustment to the Zoning Personnel account was because of the change in Hank Pittner’s title earlier this year from Building Dept./Building Inspector to Zoning Enforcement Officer. Supervisor Rice also noted that the Town has gone over in the drainage account this year because of the drainage problems it has had.

8. MOTION TO ACCEPT THE AUGUST MINUTES
A Motion to approve the August Minutes of the Town Board was made by Supervisor Ray Rice and seconded by Councilman Wayne Freer. All Town Board Members voted in favor. Motion Carried.
Councilman Gloria VanVliet and Councilman Wayne Freer believed there was a problem with the first Sept. workshop meeting minutes. This matter will be taken up at next month’s meeting.
Public Comments:
At this point in the meeting, Supervisor Ray Rice asked for public comments again.
Ray Kowatch asked what the status of the new Town Hall project was? Supervisor Rice stated that there hadn’t been any change int he status since last month. The contract has been signed, and the title search outfit is investigating the title. Mr. Kowatch then asked for copies of the minutes from the last two (2) workshop meetings. Supervisor Rice was unsure if they were complete as of yet. Councilman VanVliet and Freer believed they had to be approved by the Town Board prior to any distribution. A representative of the Daily Freeman stated this was not correct, they can be marked draft and distributed.
Jim Lamb asked if the Recreation Board was looking for more than one person? Supervisor Rice noted the Town is always looking for volunteers. Mr. Lamb then asked how many people were not on the Board anymore? Supervisor Rice stated only one (1) that he was aware of; Bonnie Hewitt, who submitted her resignation. Councilman VanVliet believed there were other openings on the Recreation Board and have been right along.
Ray Kowatch again asked about meeting minutes and wondered what went into them. Supervisor Rice stated that whatever transpired at the meeting goes into the minutes. Mr. Kowatch asked if everything that transpires goes in the minutes. Supervisor Rice said yes and further explained that once the minutes have been transcribed, then the Town Board has the opportunity to look at them and say, yes, that is really what was said, we agree with that; there wasn’t some misunderstanding. If not, they may have to go back to the tape.
Supervisor Ray Rice announced that Reports of Committees and the Correspondence were available for anyone to look at.
