PUBLIC HEARING - Sept. 20, 2007 - Local Law No. 3, 2007

A Public Hearing was held at 7:15 PM in the Town Hall on Broadway in Port Ewen, New York on September 20, 2007 on Local Law No. 3 with the following persons in attendance:

Supervisor John Coutant called the meeting to order at 7:15 PM and explained this local law Chapter 9-3 of the Town of Esopus Code is amended by adding subparagraph (D). as follows:

D. The Town Supervisor, the Chairman of the Planning Board
. the Chairman of the Town of Esopus Recreation Commission,
the Attorney for the Town and other officials that may be
hereafter designated by the town Board shall be ex officio
members of the Board.

Public Comment: None

A Motion to close the Public Hearing was made by Supervisor John Coutant and seconded by Councilperson Wayne Freer at 7:20 PM.

Opening of Town Board Meeting
September 20, 2007

A regularly scheduled meeting of the Town of Esopus Town Board was held on Thursday,
September 20, 2007 at the Town Hall on Broadway in Port Ewen, New York at 7:30 PM with the following persons in attendance:

Public Comment:

Archilles Stephanus 267 Union Center Road Ulster Park, N. Y. 12487 stated he had been to previous meetings of the Town Board to complain about the speeding, wreck less driving, and drivers disregard for the residents on Union Center Road. The situation has only gotten worse. There are less road patrols. He believes this is a quality of life issue. He spoke to Charles Schaller from Ulster County Dept. of Transportation who suggested he contact the town. A letter is needed from the Town Board requesting a speed reduction on Union Center Road and this will be done and a copy of the letter will be sent to Archilles Stephanus.

Hugh Carr - Salem St. He suggested a 30 MPH district throughout the Town of Esopus.

Happenings in Esopus: Councilperson Silvestro spoke about the Town of Esopus Festival occurring on Saturday, Sept. 29th. Many people have put in a lot of time and energy on this.
Last month the Soapbox Derby was held in Kingston and our resident Brett Owen made the front page of the Daily Freeman. In 2002, Doc Mischler left Montana with his two horses to raise money for Childhood Hunger in the USA. He stopped at the Port Ewen Pharmacy on his way to the Maple Ridge Bruderhof.

TOWN HALL UPDATE - Charles Wesley, Clerk-of-the-Works

Clerk of the Works, Charlie Wesley read his Report for August 17th through September 14th. (Attached).

Adoption of Local Law No. 3 - 2007

A Public Hearing was held this evening. The following vote was taken to approve Local Law No. 3 - 2007 Amending Chapter 9 of the Town of Esopus Code by adding subparagraph (D.) As follows:

The Town Supervisor, the Chairman of the Planning
Board, the Chairman of the Town of Esopus
Recreation Commission, the Attorney for the Town
And other officials that may be hereafter designated by
The Town Board shall be ex officio members of the
Board.

A Motion to approve Local Law No. 3 was offered by Councilperson Deborah Silvestro and seconded by Supervisor John Coutant.

1. NYSDOT Resolution

Be it Resolved, at a regular meeting of the Town of Esopus Town Board on April 21, 2005 a Resolution was adopted authorizing the Town Supervisor to be empowered to execute documents, authorizations, vouchers and other documents required by the State of New York.

Whereas, administrations have changed and authorization is required for supervisor John Coutant to be authorized to execute documents, authorizations, vouchers and other documents required by the State of New York.

Therefore, Be it Resolved, the Town Board of the Town of Esopus, County of Ulster, authorize Supervisor John Coutant to be given authorization.

2. City of Kingston, Mayor Sottile Meeting Re: Town of Esopus/City of Kingston Sewer
Treatment Agreement and Bioxide (letters 8/30/07 & 9/06/07)

It is time to renegotiate our agreement with the City of Kingston and the Town of Esopus for treatment of our sewage. We have a contract for thirty years each with three renewal periods.
There is a meeting scheduled for Sept. 26th with the Supervisor, Supt. Kiernan and the Mayor to discuss the agreement and also we now enjoy a bill from the City for bioxide that is used in the treatment of the sewage smell. This should be a $4,500 bill, however, we will be billed for use since September 2006.

3. Wapner, Koplovite & Futerfas, PLLC Letter dated 8/9/07 Re: Purchase of Gordon Property.

Scenic Hudson wants to buy property from the Gordon Family next to our Transfer Station. Their Attorneys Wapner, Koplovitz and Futerfas sent a letter to the Supervisor stating there is an encroachment of fill from the Transfer Station onto the Gordon property and they would like it tested for contaminants before purchase. After some negotiations concerning who would pay for the digging and testing.....Scenic Hudson will pay for this to be done.

4. Planning Board Resignation from John McMichael

John McMichael has been a Planning Board Member and a liaison to the Waterfront Advisory Board from the Planning Board for twelve years, as well as an alternate to the Ulster County Planning Board. John has decided it is time for him to retire and we will be looking for a replacement on these boards.

5. Peddler Permit - Karen Schmitz

Karen Schmitz has reapplied for a Peddlers Permit to sell hot dogs.

A Motion was made by Supervisor John Coutant and seconded by Councilperson Michael Lange to re-approve the Peddlers’ Permit for Karen Schmitz. All Town Board Members voted in favor. Motion Carried.

6. Somerset Check ($50,000.00) Re: Intra-municipal Agreement

The Town has received a check in the amount of $50,000 from Somerset Developers in order for the Town to deal with the infiltration problem in the sewer system.

7. Introduction of Storm-water Local Laws

Local Laws inserted here are available from the Town Clerk

Several years ago storm water regulations were imposed. “Outfalls” are where the water makes it way to the river. Highway employee Bruce Wisnoski has worked with Ulster County in August and went around the town and plotted all the “outfalls” on a GPS system. Any contamination discovered will be the town’s problem to fix. We are under a deadline to pass local laws responding to the storm water drainage and we have coupled with the county to help us get through this. We need to educate the public as to what is going on with storm water. This is becoming a major issue as far as expense is concerned.

The Town Board decided to hold the public hearings on the above local laws from 7:00 pm to 7:30 pm in five minute intervals. If more time was required it would be arranged.

A Motion to accept the Minutes of the previous meetings was made by Supervisor John Coutant and seconded by Councilperson Michael Lange. All Town Board Members voted in favor. Motion Carried.

Comments:

Councilperson Deborah Silvestro complained about people using inflatable devices at George Freer Memorial Park and tripping the electrical box because of the large amount of current needed. We should amend our code prohibiting these inflatable devices. Councilperson Freer thought there should be other alternatives as did Councilperson Lange. Supervisor Coutant would like the current running from the garage upgraded. We will discuss this fbrther in the future.

The fence has been completed at the Joseph Clark Park. The handicapped bathrooms at George Freer Memorial Park have been completed as well as the kitchen.

A Motion to adjourn was made by Councilperson Michael Lange and seconded by Councilperson Wayne Freer. All Town Board Members voted in favor. Motion Carried.
