A regularly scheduled Town Board Meeting was held on Thursday, November 19, 2009 in the Town Hall at 7 PM on 284 Broadway in Port Ewen, New York with the following persons in attendance:

Local Law No. 5 – A Local Law to Amend Chapter 34 of the Code of the Town of Esopus

 

The Public Hearing was opened at 7:07 PM by Supervisor Coutant.  This local law to Amend Chapter 34 of the Code of the Town of Esopus:  Compensation:  The members of the Planning Board may be compensated at a rate to be determined as appropriate by the Town Board.  This local law is not intended to pay the Planning Board members but it does allow for members to be compensated for travel and other like expenditures.

 

No Public Comment.

There has been no comment from the Ulster County Planning Board.

 

A Motion to close the Public Hearing on Local Law No. 5 was made by Councilperson Carl Belfiglio and seconded by Councilperson Wayne Freer.  All Town Board Members voted in favor.  Motion Carried.

 

 

Local Law No. 6 – To Amend 43-2C of the Code of the Town of Esopus

 

The Public Hearing was opened at 7:08 PM by Supervisor Coutant.  This local law to Amend Chapter 43-C of the Code of the Town of Esopus:  A Local Law with regard to the qualifications of Waterfront Advisory Board Members.  Each member shall be a resident of the town.  Members shall be chosen for their demonstrated knowledge, ability and readiness to serve the board in functions described in this chapter and with due regard for maintaining among the membership a range of special aptitudes and expertise in areas relevant to the work of the Board.  In addition, it is recommended that one member shall be a member of the Planning Board, one shall be a member of the Environmental Board and one shall be a member of the Zoning Board of Appeals.

There has been no comment from the Ulster County Planning Board.

                                                                                               

Councilperson Freer spoke about the recommendation regarding board members and said the intent is not to add more board members but to use our existing board members.  Councilperson VanVliet said

the law is being adopted because it is sometimes difficult to get a member from a specific board to serve. 

 

A Motion to close the Public Hearing was made at 7:10 PM by Councilperson Wayne Freer and seconded by Councilperson Carl Belfiglio.  All Town Board Members voted in favor.  Motion Carried.

 

 

Local Law No. 7 – To Amend Chapter 56 of the Town Code of the Town of Esopus

 

The Public Hearing was opened at 7:11 PM.  This is a local law to Amend Chapter 56 of the Code of the Town of Esopus with regard to Building Construction requirements. 

 

No Public Comment.

There was no comment from the Ulster County Planning Board.

 

A Motion was made to close the Public Hearing at 7:12 PM by Councilperson Gloria VanVliet and seconded by Councilperson Carl Belfiglio.  All Town Board Members voted in favor.  Motion Carried.

 

 

Local Law No. 8 – To Amend Chapter 76 of the Code of the Town of Esopus

 

The Public Hearing was opened at 7:13 PM by Supervisor Coutant.  The local law Amends Chapter 76-2 E (7) of the Code of the Town of Esopus with regard to Pre-submission Conference at no charge.

 

 

No Public Comment.

There was no comment from the Ulster County Planning Board.

 

A Motion to close the Public Hearing was made by Councilperson Wayne Freer and seconded by Councilperson Gloria VanVliet at 7:13 PM.  All Town Board Members voted in favor.  Motion Carried.

 

 

Local Law No. 9 – A Local Law To Amend Chapter 88 of the Code of the Town of Esopus

 

The Public Hearing was opened at 7:13 PM by Supervisor Coutant.  This local law to Amend Chapter 88 of the Code of the Town of Esopus with regard to “standards for construction of roads”.

 

Public Comment:    Roxanne Pecora, Chairperson of the Planning Board stated Highway Supt. Al Larkin has been most helpful with regard to implementing this local law.

Local Law No. 10 – To Amend Chapter 107 of the Town Code of the Town of Esopus

  

The Public Hearing was opened at 7:14 PM by Supervisor Coutant.  This is a local law to Amend Chapter 107 of the Town of Esopus with regard to revising the Subdivision Regulations.

 

No Public Comment.

There has been no comment from the Ulster County Planning Board.

 

A Motion to close the Public Hearing on Local Law No. 10 was made by Councilperson Carl Belfiglio and seconded by Councilperson Gloria VanVliet at 7:14 PM.  All Town Board Members voted in favor.  Motion Carried.

 

 

Local Law No. 11 – A Local Law to Amend Chapter 123 of the Code of the Town of Esopus

 

A Public Hearing was opened at 7:15 PM by Supervisor Coutant.  This local law will strengthen Chapter 123 of the Town of Esopus Town Code with regard to Zoning Regulations.  Councilperson Wayne Freer

Had a concern with page 2 - Chapter 123 E (b) “In any NC, BC, or GC Districts, such permitted signs shall be illuminated by use of shielded light fixtures such that no glare escapes beyond the property line nor is projected out onto any street.  These lights must be turned off by 10 PM local time.”   Councilperson Freer did not believe businesses should have to shut their lights off at 10 PM.  Many businesses are open 24 hours and it stops them from advertising.  (c) “In other zoning districts in the Town where home occupations are permitted, no sign shall be illuminated.”  Councilperson Freer said home businesses should be allowed to light their sign. 

 

A Motion was made by Supervisor John Coutant and seconded by Councilperson Wayne Freer to eliminate section E (b) of Chapter 123 from the local law.  All Town Board Members voted in favor.  Motion Carried.

 

There was discussion about E (c) of Chapter 123.  “In other zoning districts in the town where home occupations are permitted, no sign shall be illuminated.”  Councilperson Gloria VanVliet stated most home businesses lights should not be allowed to 11 PM at night.  Councilperson Freer disagreed.  Some home businesses are in commercial districts.  There is a problem with lighting home signs.  There was a problem with a lighted sign shining in an apartment window.  Town Planner Myles Putman suggested eliminating this © section.  Councilperson Silvestro asked how many houses have a pole wherever they want or a spotlight?  It is not that offensive. 

 

Roxanne Pecora the reason for this law is our Building Inspector Tim Keefe would have flexibility. The Town sign would be in violation.

 

A Motion was made by Councilperson Wayne Freer that section E © of Chapter 123 be eliminated.  Supervisor Coutant seconded the Motion.  All Town Board Members voted in favor.  Motion Carried. 

                                                                                               

Section 123-55 Y G.  is amended by adding a new subsection 123-55G as follows:

 

G.  Time limit on validity of site plan approval.  Approval of a site plan for an approved              designated PUD shall be subject to the time periods set forth for approved site plans set forth in Section 123-47. E of this code, unless extended by the Planning Board, upon request of the developer.

 

Councilperson Silvestro was concerned with what we discussed at our Workshop Meeting….changing from the Planning Board to the Town Board.  PUD’s are unique and rare and Town Board generated.  Roxanne Pecora said this has nothing to do with PUD’s.  This law relates to Site Plan after the PUD’s are approved.  If you change this and add G, this is a zoning matter.  PUD’s contain nothing about Site Plans and that is why it needs to be in the law.  Supervisor Coutant said the Town Board is not giving up the approval process with PUD’s.  The Planning Board has always had responsibility to make the Site Plan work.  The Site Plan does not go back to the Town Board.  Councilperson Silvestro believes the Town Board should have some influence as to the extension of the PUD.

 

A Motion was made by Councilperson Wayne Freer and seconded by Councilperson Deborah Silvestro

to eliminate on page 5 item Y) Section 123-55 G “Time limit on validity of site plan approval.  All Town Board Members voted in favor.  Motion Carried.

 

A Motion to close the Public Hearing on Local Law No. 11 was made by Councilperson Carl Belfiglio and seconded by Supervisor John Coutant at 7:45 PM.  All Town Board Members voted in favor.  Motion Carried.

 

 

                Local Law No. 12 – A Local Law to Regulate Outdoor Wood Fired Hydronic Heaters

Chapter 97 – Outdoor Wood-Fired Hydronic Heaters and Boilers

 

The Public Hearing was opened at 7:45 PM by Supervisor Coutant.  This local law will Regulate Outdoor Wood Fired Hydronic Heaters – Chapter 97 – Outdoor Wood Fired Hydronic Heaters and Boilers.  There is a situation in town which this law will rectify said Supervisor Coutant.

 

Public Comment:  None

There has been no comment from the Ulster County Planning Board.

 

Councilperson Wayne Freer mentioned the existing stoves that are in town will still exist, however, the standards of what they will be burning will be enforced.  Councilperson Silvestro – any existing hydronic heater will be required to get a permit from the Building Inspector within a year.  Supervisor Coutant said Section 97-A states, “No fuel shall be used within an OWFHH except for seasoned hardwood.  The following fuels are strictly prohibited for use in an OWFHH:  painted, treated or coated wood, unseasoned wood, coniferous or soft wood, rubbish and garbage, plastic, rubber, newspaper, cardboard, printing paper and any addition items specifically listed as unacceptable by the manufacturer of the OWFHH.”  The Supervisor said the DEC rules are not as strict for they allow the burning of household garbage and we do not.  Councilperson Silvestro said the manufacturers of these heaters recommend that you do not burn garbage because it will affect the performance and the quality of life for the neighbors.  Councilperson Freer said we have a few of these units already in the town and the regulations for what they can burn in the future is fine but I have a problem with sending them back to the Building Inspector and charging a fee which they have already done.  Supervisor Coutant said there has always been a charge to place in a wood burning device.  Councilperson Silvestro said there is no law that governs these units on our books, however, when they come to the Building Inspector asking do I  a permit …the only thing he can give them a permit is  for a wood burning fireplace.  Councilperson Freer feels we should not go back to these two or three individuals who have already installed them.  Councilperson Silvestro said there are more than two or three.  After speaking with Joan Boris there are eight or nine.  Councilperson Freer asked if it was fair for those people who have already installed the unit.   Councilperson Silvestro answered it is the only way you can let them know what the law is regarding these units.  Councilperson Freer had a problem with this.  Councilperson Belfiglio asked how would you know they were installed according to the manufacturer’s guidelines.  It would be wise to revisit them to make sure they are safe and Councilperson VanVliet agreed.  Our Building Inspector will oversee them.

 

 

George Michaelides – These stoves are completely different for people have been burning wood stoves for years but if you live next to one the stench is putrid and it doesn’t matter what they burn.  They are toxic.  Burning garbage has to be stopped.  This unit has a small chimney and even when my windows are closed you can smell the garbage.  It is like living next to a dump when the methane gas is burning.  Everyone in my neighborhood has wood stoves they are no problem but this unit even if it had a high chimney it would not help.  These things burn very inefficiently.  They burn 72 grams an hour compared to a wood stove that burns 2 grams.  Since October it has been torture.  The unit smolders and the black smoke drifts all day long.  He is afraid the existing heaters will slip through the cracks. 

 

Councilperson Silvestro said some towns have outright banned these furnaces.  One of the reasons why people were reluctant to pass this law originally was the residents who are suffering because of the cost of fuel oil needed an alternative for them to heat their homes.  You are talking about an item that is not a cheap machine.  We have one placed in the town and it costs $14,000 and another cost $11,000.  These are not cheap pieces of equipment.  It will not be unreasonable to ask someone to come back in to get a permit and the Town Board has the right to choose how much the permits will be.  You could change how much a second permit will be.  This is a reasonable law that sets minimum chimney heights.  The reason If we lived in a ideal world we would not need these laws.  People will do what they want to do and damn everyone else.   Councilperson Freer said this second permit would insure the unit was installed properly.  Councilperson Belfiglio believes some units will be in violation because they are not 200 ft. from the next residence or because their chimney is not high enough.

 

A Motion to close the Public Hearing was made by Councilperson Belfiglio and seconded by Councilperson Silvestro at 8:02 PM.  All Town Board Members voted in favor.  Motion Carried.

                                                                               

 

Local Law No. 13 – To Amend Certain Provisions of Chapter 80 of the Code of the Town of Esopus (Flood Damage Prevention)

 

The Public Hearing was opened at 8:02 PM by Supervisor Coutant.  This is a local law to amend Local Law No. 1 – 2009 which was passed earlier this year.  The NYS required towns to pass certain legislature with regard to Flood Damage Prevention and the Town of Esopus complied; however, upon filing the local law with the State, several changes were required by the State and we were asked to amend the law.

 

Public Comment:  None

There was no comment from the Ulster County Planning Board.

Local Law No. 14 – To Amend Local Law No. 2 of 1998 Titled “A Local Law Establishing the Eligibility for Medical Insurance Benefits and Elected Officials.

 

 

The Public Hearing was opened at 8:04 PM by Supervisor Coutant.  This is a local law to amend Local Law No. 2 of 1998 establishing medical insurance benefits for elected officials.

 

Public Comment:  None

There was no comment from the Ulster County Planning Board.

Councilperson Silvestro voted no because this local law will illegally set hours for elected officials.

 

*Addendum:  The Ulster County Planning Board Principal Planner Robert Leibowitz, called Nov. 18th to say the Ulster County Planning Board Comments were faxed to the Town Clerks’ Office at 3:50 PM on Nov. 17th, however, the Town Clerk was unaware of this FAX at the time of the meeting.  Mr. Leibowitz stated the Town Board must wait to vote until Nov. 21st to fall within the thirty day limit from the time the local laws were hand-delivered to the Ulster County Planning Office, however, since this was the last day of submittal we believed we were in time for the vote.  He believed the vote was null and void.  The Town Clerk called or emailed the Town Board Members on Monday, Nov. 23rd giving them the information provided by the Ulster County Planning Board and their vote remained the same, unanimously in favor of adopting Local Laws No. 5 thru 14.                                                                                 

 

 

2.  RESOLUTION – EMPLOYEE HEALTH INSURANCE RESOLUTION

 

Be it Resolved, by the Town Board Town of Esopus, County of Ulster, State of New York, as follows:

 

Whereas, the Town Board has carefully reviewed and considered the health insurance and the cost of health insurance premiums provided to employees in the Town,

 

Therefore, Be it Resolved, that following careful consideration the Town Board has determined that the employees shall pay 5% of their health insurance premium effective January 1, 2010.

Be it Resolved, by the Town Board of the Town of Esopus, County of Ulster, State of New York, as follows,

Whereas, the Town Board has carefully reviewed and considered the health insurance and the cost of

Health insurance and the premiums of health insurance provided to retired employees in the Town.

 

Therefore, Be it Resolved, that following careful consideration, the Town Board has determined that employees who retire after December 31, 2009, shall pay 5% of their health insurance premiums effective January 1, 2010.

Be it Resolved, by the Town Board of the Town of Esopus, in the County of Ulster, State of New York, as follows,

 

Whereas, Lorie Morris, Town of Esopus Assessment Review Board, appointment expires on 9/30/09.

 

Therefore, Be it Resolved, that the Town of Esopus Town Board reappoints Lorie Morris to a five year term to expire on 9/30/09.

Payment of Vouchers

 

RESOLUTION AUTHORIZING PAYMENT OF BILLS SINCE OCTOBER 19, 2009 TO NOVEMBER 19, 2009

 

Be it Resolved by the Town Board of the Town of Esopus, County of Ulster as follows:

 

Whereas, the Town of Esopus has been presented with vouchers for payment and these vouchers have been examined and approved by the Town Board

 

Now, Therefore, Be it Resolved, that the following vouchers be approved for payment:

Approval of Minutes 

 

 

Councilperson Belfiglio said within the last month there has been a lot of minutes and they are too long and he wondered if they could be amended after they were approved?  The Town Clerk said if there weren’t so many meetings and if there wasn’t so much discussion the minutes would be shorter.  You do not have to approve the Town Clerks’ Minutes.  These minutes can be amended by the Town Board, however, the amendment is placed on the side of the original minutes to note the change. 

 

A Motion was made by Councilperson Carl Belfiglio to approve the minutes and the Motion was seconded by Councilperson Gloria VanVliet.  All Town Board Members voted in favor.  Motion Carried.

A Motion to adjourn the meeting was made by Councilperson Wayne Freer and seconded by Councilperson Gloria VanVliet at 8:42 PM.  All Town Board Members voted in favor.  Motion Carried.
