Town of Esopus Zoning Board of Appeals
     Minutes
        January 17, 2006

The meeting was called to order at 7:32 p.m. by Chairman Don Cole. The Pledge of Allegiance to the Flag followed.

ROLL CALL

Present: Catherine Charuk, Don Cole, Darin DeKoskie, Joe Guido, Rob Hare, and Karl Wick.
Excused: Richard Wenzel

APPROVAL OF MINUTES

KARL WICK MADE A MOTION TO ACCEPT THE MINUTES AS SUBMITTED. ROB HARE SECONDED. ALL PRESENT VOTED IN FAVOR.

APPROVAL OF VOUCHERS

Two vouchers, one for a public hearing notice from the Freeman and one for secretarial work, were submitted. JOE GUIDO MADE A MOTION TO APPROVE THE VOUCHERS. ROB HARE SECONDED. ALL PRESENT VOTED IN FAVOR.

DECISIONAL MEETING

BASLER, MICHAEL Case # 10-18-05-01

Mr. Basler presented photos of his property and one of the shed for the record. He explained that the picture of the shed is pretty much the same size and color of the one he will be buying.

There were no questions or objections from the Board. JOE GUIDO MADE A MOTION TO GRANT A VARIANCE TO ALLOW PLACEMENT OF A 12X20' SHED NEARER TO THE ROAD THAN THE PRINCIPAL BUILDING BUT NO CLOSER TO THE ROAD THAN 90". CATHERINE CHARUK SECONDED. The vote was as follow:

   KARL WICK - I vote in favor. I think it meets the intention of the law. There are certainly hundreds of similar yards in the town.

   DARIN DeKOSKIE - I vote in favor. The spot for the shed is one of the better ones because of the topography.

   ROB HARE - Iím going to vote in favor. The topography doesnít allow placement elsewhere. The applicant showed need for the shed.

  DON COLE - I vote in favor for all the previous reasons.

   JOE GUIDO - Iím against it. I think this is the kind of building and situation that the law was intended to stop.

   CATHERINE CHARUK - I vote in favor. It will be 90' back from the road and the terrain warrants it.

Motion carried 5-1.

OTHER BUSINESS

Joe Guido said he would like to thank the Town Board for keeping the Zoning Boardís secretary. Karl Wick asked if anything further was heard about the Light Industrial zone issue. Mr. Cole stated that nothing was heard but he talked to Roxanne and she said that the applicant did not give all that was required to the Planning Board. Mr. Cole also said that after the discussion this Board had last month, he wanted to send a letter to the Planning Board but this Board said no, the Planning Board knows what has to be done. He just wanted them to be aware that this Board knows what is going on also. Once he talked to Roxanne he found out that this Board doesnít  know everything that is going on, but the will be kept abreast of what happens in the future.

Mr. Cole asked if the minutes of the Planning Board were received and the secretary advised that she believes that they were. Mr. Cole also asked if the secretary found out why the letter from Mr. Pisani was not in the Zoning Board mailbox. The secretary advised that she did not find out why but she will put an arrow next to the label on the box in the Town Clerkís office. It may be that whoever is putting mail in the box is not aware of which box, the one above or the one below the label, is the correct one.
