Town of Esopus Zoning Board of Appeals
JULY 15, 2008
Chairman Don Cole called the meeting of the Zoning Board of Appeals of the Town of Esopus to order at 7:30 p.m.
The Pledge to the Flag followed.
Present: Don Cole, Chairman, Karl Wick, Vic Barranca, Rob Hare, Kathy Kiernan, and Linda Smythe.
Absent: Joe Guido
APPROVAL OF MINUTES
VIC BARRANCA MADE A MOTION TO APPROVE THE MINUTES AS WRITTEN. KARL WICK SECONDED. ALL PRESENT VOTED IN FAVOR.
APPROVAL OF VOUCHERS
KARL WICK MADE A MOTION TO APPROVE THE VOUCHER FOR SECRETARIAL WORK AND LEGAL NOTICES IN DAILY FREEMAN. ROB HARE SECONDED. ALL IN FAVOR.
CARPINO, JOANNE CASE # 07-15-08-01
Joanne Carpino was present.
Don Cole asked Mrs. Carpino to explain what she proposed to do.
Mrs. Carpino stated that she would like to erect a Brad’s Barn (garage). The size will be a 12 x 18, and it is to store a classic car. Mrs. Carpino showed pictures of her property. There is nowhere else on the property to place the garage.
The Chairman informed Mrs. Carpino that the next meeting would be a Public Hearing. The meeting will be held on August 19th, 2008.
Don Cole asked the Board if they had any questions.
Karl Wick stated that there would be other variances required. Side yard, front yard, and a variance for a building in the front of house.
Don Cole asked if a drawing had been submitted. Karl said “yes, but it is not scaled.”
Rob Hare asked Mrs. Carpino if she had laid out the drawing herself? Mrs. Carpino stated yes, her son had come over and they measured it out. Mrs. Carpino stated that there is a very big tree in the front of the property and she wanted to place the garage as close to the property line as she could. There is an existing shed in the rear yard. There are also many rocks in the rear yard. That is the reason the existing shed is not converted into a garage.
Mrs. Carpino gave her telephone number to the Board in order that they might call and make on site visits.
Karl Wick asked if there were measurements from the house to the neighbor’s property line. Mrs. Carpino stated she had not done that and Karl requested that she do that by the next meeting.
Don Cole asked the size of the lot. We will need depth and width.
The size of the garage will be 12 x 18.
Karl Wick asked what the flooring would be. Mrs. Carpino thought it was 4 x 4 pressured treated flooring. Also a crushed stone floor was discussed.
Kathy Kiernan asked what was on the other side of Mrs. Carpino’s lot. It is all open. It is all grass and trees.
There were no other questions. A Public Hearing will be August 19th, 2008.
There was a discussion on accessory apartments. Hardship is a reason for granting an accessory apartment. However, what happens when that person in no longer there? Rob Hare pointed out that on a previous granted variance for an accessory apartment we stated the property had to be owner occupied and the person in the apartment had to be a relative. The question really is “What is the purpose of the accessory apartment?” In addition, there is the question when the building was built. There are a number of advantages for an accessory apartment.
Don Cole stated a caretaker is permitted by law to live in an accessory apartment.
Accessory apartments can be confusing and maybe down the road it should be addressed again. But, we will address what is today and try to help families stay together.
Kathy Kiernan made a motion to adjourn the meeting. Linda Smythe seconded. All in favor.
The meeting was adjourned at 8 p.m.
